1. Introduction

Welcome to CruiseAlert ("we," "us," or "our"), a service operated by Destinations Media & Travel, a company incorporated in the Netherlands, and accessible at cruisealert.com. These Terms of Service ("Terms") govern your use of the CruiseAlert platform, including our website, price alert tools, and related services (collectively, the "Service").

Please read these Terms carefully before using the Service. By creating an account or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. About CruiseAlert

2.1 What We Do

CruiseAlert is a price tracking and alert platform. We:

Track publicly available cruise pricing data from cruise line websites
Send you email notifications when prices change or drop
Help connect consumers with licensed travel agents (optional, with your consent)
Provide cruise price history and availability information

2.2 What We Are Not

CruiseAlert is not a travel agency, booking platform, or financial advisor. We do not:

Book cruises on your behalf
Hold inventory or guarantee availability
Set or negotiate cruise prices
Provide travel advice or financial recommendations

All bookings must be made directly with cruise lines or through a licensed travel agent.

3. Eligibility

3.1 Age Requirement

You must be at least 18 years old to create an account or use the Service. By using the Service, you represent and warrant that you are 18 or older.

We do not knowingly collect information from anyone under 13. If we discover we have collected information from a child under 13, we will delete it promptly. See our Privacy Policy for details.

3.2 Capacity

You represent that you have the legal capacity to enter into a binding agreement in your jurisdiction.

3.3 Prohibited Users

You may not use the Service if:

You have been previously banned or suspended from the Service
You are located in a country subject to a US government embargo
Applicable law prohibits you from using the Service

4. Accounts

4.1 Account Creation

To access certain features, you must create an account using a valid email address and password. You agree to provide accurate, current, and complete information.

4.2 Account Security

You are responsible for:

Maintaining the confidentiality of your password
All activity that occurs under your account
Notifying us immediately at legal@cruisealert.com if you suspect unauthorized access

We are not liable for losses caused by unauthorized use of your account.

4.3 One Account Per User

Each person may maintain only one account. Creating multiple accounts to circumvent restrictions is prohibited.

5. Price Data Disclaimer

This section is important. Please read it carefully.

5.1 Data Source

CruiseAlert collects cruise pricing data by accessing publicly available pages on cruise line websites. We do not have a commercial data relationship with any cruise line, and we are not affiliated with, endorsed by, or sponsored by any cruise line.

5.2 Data Accuracy

Prices displayed on CruiseAlert:

May be delayed — data is updated daily, not in real time
May be incomplete — we may not capture every cabin grade, sailing, or promotional price
May contain errors — data collection technology is imperfect and data can be misread
Are not guaranteed — the actual price at booking may differ from what we display

5.3 No Booking Guarantee

CruiseAlert price alerts are for informational purposes only. A price alert does not:

Reserve your cabin or guarantee availability
Lock in the displayed price
Constitute a booking confirmation
Create any obligation on the part of any cruise line

Always verify current pricing directly with the cruise line or a licensed travel agent before making any booking decision.

5.4 "Sold Out" Detection

When a cabin grade no longer appears in our data, we may display a "Likely Sold Out" indicator. This is an automated inference based on data absence — it is not a definitive confirmation of availability status.

5.5 No Endorsement

Displaying a cruise line's pricing data does not imply endorsement, sponsorship, or any commercial relationship between CruiseAlert and that cruise line.

6. Acceptable Use

6.1 Permitted Uses

You may use the Service to:

Track cruise prices for personal or professional travel research
Set up price alerts for sailings you are interested in
View price history for sailings we track
(Travel agents) Monitor prices on behalf of clients through the B2B platform

6.2 Prohibited Activities

You may not:

a) Automated or Bulk Access

Use bots, scrapers, crawlers, or automated tools to access the Service
Make excessive automated requests that burden our infrastructure
Systematically download or reproduce our compiled price data

b) Misuse and Abuse

Use the Service in any way that violates applicable law or regulation
Impersonate any person or entity, or misrepresent your affiliation
Submit false, misleading, or fraudulent information

c) Interference

Attempt to gain unauthorized access to our systems or other users' accounts
Introduce malware, viruses, or other harmful code
Interfere with or disrupt the integrity or performance of the Service

d) Commercial Exploitation

Resell, sublicense, or commercially redistribute our price data without written authorization
Use price data to train machine learning models without written authorization
Build a competing service using data derived from CruiseAlert

6.3 Travel Agent Accounts

Travel agents using agents.cruisealert.com are also subject to the Agent Terms of Service, which govern their additional obligations regarding consumer data handling.

7. Email Alerts and Communications

7.1 Alert Emails

By creating a price alert, you consent to receive email notifications when the tracked conditions are met. These are transactional communications related to the Service.

7.2 Marketing Emails

We may send marketing emails (news, features, promotions) only if you have opted in. You can unsubscribe at any time using the link in any marketing email or through your account preferences.

7.3 CAN-SPAM Compliance

All marketing emails include our physical mailing address and a functional unsubscribe mechanism. We will process unsubscribe requests within 10 business days.

8. Intellectual Property

8.1 Our Property

The CruiseAlert platform, including its design, software, compiled price datasets, features, and branding, is owned by CruiseAlert and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8.2 Your Content

You retain ownership of any content you submit (e.g., your alert configurations, profile data). By submitting content, you grant us a limited license to use it solely to operate and improve the Service.

8.3 Cruise Line Data

Cruise pricing data is sourced from publicly available cruise line websites. All trademarks, logos, and brand names mentioned on the platform (e.g., Royal Caribbean, Carnival, Norwegian) belong to their respective owners. Their appearance does not imply affiliation or endorsement.

8.4 Feedback

If you provide feedback or suggestions about the Service, we may use them without obligation to you.

9. Third-Party Services

The Service relies on third-party providers for infrastructure, hosting, email delivery, authentication, and content delivery. Your use of the Service may also be subject to the terms and privacy policies of these third-party providers where applicable. We are not responsible for the practices of third-party services.

10. Disclaimers

10.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

10.2 No Uptime Guarantee

We do not guarantee that the Service will be available at all times or without interruption. We may perform maintenance, updates, or experience outages outside our control.

10.3 Price Data

We make no warranty that price data is accurate, current, or complete. Prices displayed are informational estimates and may not reflect actual availability or current pricing from cruise lines.

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRUISEALERT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, goodwill, or business opportunity
Damages arising from your reliance on price data that proved inaccurate
Missed bookings, travel arrangements, or financial losses due to incorrect alerts

11.2 Cap on Liability

TO THE EXTENT WE HAVE ANY LIABILITY, IT SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

12. Indemnification

You agree to indemnify and hold harmless CruiseAlert and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from:

Your violation of these Terms
Your use or misuse of the Service
Your violation of any applicable law or third-party rights
Content or data you submit to the Service

13. Termination

13.1 Your Right to Terminate

You may close your account at any time by contacting us at legal@cruisealert.com or using the account deletion feature in your settings. Upon deletion, we will process your data per our Privacy Policy and Data Retention Policy.

13.2 Our Right to Terminate

We may suspend or terminate your account at any time if:

You violate these Terms or our Acceptable Use Policy
We are required to do so by law
Your account shows signs of fraud or abuse
We discontinue the Service

13.3 Effect of Termination

Upon termination:

Your access to the Service will cease immediately
Active price alerts will be cancelled
We will handle your personal data per our Privacy Policy

Sections 5, 8, 10, 11, 12, 14, and 15 survive termination.

14. Dispute Resolution

Note for attorney review: Arbitration clauses and class action waivers require careful drafting and may not be enforceable in all jurisdictions. This section should be reviewed and tailored by a qualified attorney.

14.1 Informal Resolution First

Before initiating any formal proceedings, both parties agree to attempt to resolve disputes informally by contacting legal@cruisealert.com. We will try to resolve disputes within 30 days.

14.2 Binding Arbitration

If informal resolution fails, disputes shall be resolved by binding individual arbitration in accordance with applicable arbitration rules. The arbitration shall take place in the Netherlands, or by video conference.

14.3 Class Action Waiver

YOU AND CRUISEALERT WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

14.4 Exceptions

Either party may seek emergency injunctive relief in court. Small claims court actions remain available where applicable.

14.5 EU/EEA Users

If you are located in the EU or EEA, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes not resolved by arbitration shall be submitted to the competent courts in the Netherlands.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

Post the updated Terms at cruisealert.com/legal/terms
Update the "Last Updated" date at the top of this document
Notify you by email if you have an active account

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and CruiseAlert regarding the Service.

17.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.

17.3 No Waiver

Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.

17.4 Assignment

We may assign these Terms (e.g., in connection with a merger or acquisition) without your consent. You may not assign your rights under these Terms.
